Ken (Clark) Has a Go At The ECHR!

An eye-opener for many, but Ken Clark has shown his heart is in the right place by attacking the sheer stupidity of the European Court of Human Rights(ECHR). During a speech to the Austrian Diplomatic Academy in Vienna he said in no uncertain terms that the ECHR was in desperate need of reform. After their ruling on the Abu Qatada case, and that prisoners in our country should have full voting rights, I tend to agree.

He claims that the courts are overloaded, and when you take into consideration that in the first 40 years of its existence it handled a total of 45,000 cases, and in 2010 alone 61,300, I can see what he means.

During his speech he said:  ¨It is individual states and their courts which have primary responsibility for implementing the convention and granting effective remedies. At times, I consider that the court has been too ready to substitute its own judgment for that of national courts and parliaments. It was never meant to be a court of appeal for routine domestic judgments. No court could ever hope to offer redress to 800 million people. National courts are in the best position to understand national problems.” In that I have to agree.

In my opinion, there are more than sufficient safeguards within the national justice system to ensure fairness. What gets peoples backs up in this country is the interference from Strasbourg that dictates e.g. Abu Qatada the terrorist can neither be held in custody, nor deported to Jordan. Also, how dare such a body dictate to us that convicted criminals have as much right to vote as law-abiding citizens?

Abu Qatada is not the only one to have escaped deportation on ´Human Rights´grounds, there have been many before him, such as  Mohammed Ibrahim who ran over a young girl (Posted 17/12/2010). On top of that, many criminals have used the infamous Article 8 (Right to family life) defence to escape a jail sentence, in particular I think of burglar Wayne Bishop who I wrote about on the 28th May last year. He escaped a prison sentence because he had five children. He was re-arrested recently on GBH (grievous bodily harm) charges. So much for the loving father whose children cannot live without him.

There have been too many cases where the ECHR has made a mockery of justice in our country, and it has to stop. I for one will be very happy if Ken Clark and David Cameron can introduce legislative changes to the way in which the court operates during Britain´s tenure at the`head of the table´.  If that happens, and we rid ourselves of the ridiculous `Human Rights´ appeals to every sentence handed out by the courts, so much the better.

Ken's On A Roll!

After a year of bumbling, Ken Clark the Justice Secretary, has at last got his priorities right and is doing something useful for a change. It seems he is finally taking positive steps to stop the endless court appeals of people who are due for deportation from the UK.

Ever since the European Human Rights Act (EHRA) came into force in 1998, anyone who is rejected the ‘Right of Abode’ in Britain for criminal or others reasons has had the legal right to appeal a deportation order time after time. This has meant that they could stay in the country at tax payers expense for years while their endless appeals are heard.

Danga and Girlfriend - How Can She Have Two Children With a Twice Convicted Rapist?

The stories of callous criminals who have used this Act are endless. William Danga, a Congolese convicted of raping two young girls (one aged four) was released in 2006 after serving just half of a ten year sentence. He was ordered to be deported but claimed he ‘lost’ his passport which prevented it. He then jumped on the ‘appeal train’ and used the well-tried ‘Article 8’ (Right to Family Life) of the EHRA because he had children with his english girlfriend. He has since been arrested and convicted on fresh rape charges, and sentenced to fifteen years after which authorities will try once again to deport him.

Ibrahim - A Callous Killer

Just two months ago, Nigerian rapist Akindoyin Akinshipe also used the same defence and beat his deportation order. Some time ago I reported on Aso Mohammed Ibrahim, an Iraqi Kurd with a long criminal history, who sidestepped deportation after he ran over a 12 year-old girl with his car and left her to die in the road. He too used the Article 8 ‘right to family life’ defence.

In fact a total of 200 immigrant criminals have won the right of abode in the UK using the infamous Act, which to me is a shocking state of affairs. The whole sordid affair is an outrage to common decency and an insult to the good people of any nation.

Open To Misuse

Now it seems our judiciary are moving towards a UK Bill of Rights that could replace the Human Rights Act if the Conservatives have their way, however, it is reported that Nick Clegg of the Liberal Party is saying the EHRA must stay and is opposed to the idea. If that is true, then I have one thing to say to Mr. Clegg: “Sir! You are a disgrace” (and I am being very kind and very polite!!!!!!).

Ken Clark said the new laws would put an end to the situation where “everybody who’s just lost his arguments about deportation should be able to go there and get in the queue, wait a few years to get it all re-heard again when he’s lost the argument three times already”.

Council of Europe - Member Countries

It is Britain’s turn to hold the chairmanship of the Council of Europe, which oversees the court, and this began earlier this month. Mr Clarke said: “A lot of member states have been pushing for similar things, and a lot of them believe a British chairmanship is the best time to deliver it, and they think we’re the best hope of drawing this to a conclusion. The term human rights, it gets misused. There is a tendency in this country for the words human rights to get thrown about as much as health and safety. Both of them get hopelessly misused.” Well, I have to say you got that right Ken! 

He says the agreement with the European Court of Human Rights could be agreed as early as  April next year at a conference to be held in London. Personally, I think tomorrow would be better!!!!

‘Tough’ Community Service – Another Ken Clark Option Doomed To Failure!

I know money is tight and the prisons are full, but I cannot for the life of me understand how our Justice Minister, Ken Clark, keeps rattling on about ‘Community Service’ being the answer to re-offending! This man is so out of touch with public opinion as to be laughable. Even his own government department statistics say he is totally wrong. Many Tory M.P’s were angry at his move away from tough sentencing.

Time To Go?

I am sorry Ken, you have given your country good service over the years, but you really should consider retirement.

He promises that instead of sitting at home watching TV or being down the pub having a beer when they are supposed to be doing community service, prisoners will be made to work a minimum of 28 hours a week paying back the community doing odd jobs like clearing up litter and painting!

THIS Is Hard Work - 48 Hours A Week!

Considering that working people put in at least 48 hours a week I don’t call that ‘Hard Labour’ as he calls it. I also don’t think clearing up rubbish and painting is ‘hard labour’!

True, he is stuck with a problem in that the prisons are full and cost the country a fortune, but there are far better ways than this stupid idea. Criminals should be ‘banged up’ and anything less is just not good enough.

Even Women Prisoners Get To Improve Their Snooker Skills

If he really needs to cut expenses, take away all the TV’s, pool tables, gym machines and other luxuries that prisoners enjoy daily. Things which law-abiding people cannot afford! The cost of all these items comes from his Justice Department budget, and consequently the tax payer. That’s how you save money Ken!!!!

It is time all these superfluous things were taken away and the prisons turned back into places of punishment, not 5 Star hotels. Criminals in British prisons consider our penal system a joke, and that is why they turn to a life of crime, and why they re-offend as soon as they are released, sometimes within days for cryin’ out loud!

After A Hard Day Playing Snooker

Our Ken is so out of touch, he is even giving them a day off to look for a job; “Where convicts are unemployed, they will be forced to work a minimum of 28 hours over four days, with the fifth day spent looking for a job”. At least they will have time enough for a drink with their mates, or perhaps commit another crime!!!!

For the last thirty years, the public have been begging each successive government to ‘get tough on crime’, and sure enough, during each election all parties swear they will be.

Labour went the other way during their last term in office. Under them, less than half of all community orders were completed, and one in ten was cut short because the person doing it reoffended before completing  it. Criminals placed on community orders in 2008 committed almost a quarter of a million offences in the following 12 months. Of these, 1,500 were serious crimes such as murder and rape.

Although we have had promises (as usual) from the Conservatives and Liberals, what they are proposing still isn’t enough!

How Our Cells Are....

It is time Britain had its own Bill of Rights (even though we have the Magna Carta), and all these ‘Human Rights’ nutters should be told to go jump off the nearest cliff.

You cannot turn people away from a life of crime by being soft, and hoping they will change their ways. In our society, criminals, and especially young ones, see crime as the ‘way to go’. If caught they have little to fear, as is proven time and again by the fact many re-offend even while on bail for the first offence.

....And How They Should Be!

The youth of today are feared by much of the population, and they revel in it. It gives many a ‘buzz’ to see honest citizens cross the road rather than share a pavement with them. They are drunk with their own perceived ‘power’ and exercise it at will. They have no fear of going to prison, because it will at least give them chance to play a few rounds of snooker!

People have been complaining about the ‘harsh’ sentences handed out following the recent riots, but folks, that’s what you have been asking for all these years. Finally you get a government that is fulfilling your wishes, and you still complain!!!!!!

You Want To Give HIM A Slap-on-the -Wrist?

Stop whining and support those of our politicians who are willing to give out harsh sentences. Only by insisting the law return to complete impartiality can we hope for a return to any form of normalcy. Breaking the law is breaking the law, no matter how trivial the offence may seem!  

Campaign, or start a petition to get rid of all the luxuries prisoners enjoy on a daily basis, and insist our prisons return to what they once were; A place of punishment. Only by putting the fear of God into criminals will we ever persuade them to change their ways!
