I cannot believe that a so-called ‘educated’ man can tell the government that we should not send thieves and fraudsters to jail!  Prof Andrew Ashworth, a ‘legal expert’, and Vinerian Professor of English Law at Oxford University, has produced a pamphlet  to be distributed in which he says that jail time should be reserved for those “who commit crimes of a violent, sexual or threatening nature”.

He also argued against imprisoning repeat, non-violent offenders. He said, “for ‘pure property offences’, including theft, handling of stolen goods, criminal damage and fraud, imprisonment was disproportionate”. In his words, “Instead, the priority should be to deal with such offences in the community, giving precedence to compensation or reparation for the victim and, where the offence is sufficiently serious, imposing a community sentence.”

He claims that some 20,000 people go to prison each year for theft or handling stolen goods, 5,000 for fraud and 1,000 for criminal damage. The effect of his policy would reduce the number of men serving prison sentences by 8% (5,000 men) and women by 21% (700 women), saving around £230m each year.

O.K. clever dick, how you ‘compensate’ a couple who have been robbed of everything of value in their house? Pass the buck onto the insurance company who will pay a fraction of the value of the stolen articles, if they pay at all?  How do you ‘compensate’ old age pensioners who have been robbed of their most cherished possessions gathered over many years, and who may suffer serious illness as a result of the loss? What planet does this idiot live on, certainly not ours! It seems fairly certain that this pontificating fool has never been robbed or assaulted by a criminal. Perhaps he should go and talk to the many victims of crime before mouthing off!

This has raised a huge response from the public and many are saying that prison time does not stop re-offending, which is often true. So let us look at this argument and bisect the problems involved with keeping crime off our streets.

I agree with most of the comments that currently, prison does not stop the majority of criminals from re-offending, but that is for one simple reason, ever since the introduction of the Human Rights Laws we have been forced to turn our prisons into something resembling a holiday camp compared to the past.  We see often enough pictures of prisoners playing pool, lounging around, and of course every one has a TV, music and /or games centre in their cell. They have curtains on the windows so the sight of the bars will not traumatized them (oh my goodness, heaven forbid that they should be traumatized!), and the days of them doing hard labour are long behind us. Many of the custodial sentences handed out by the court, IF they get one, are so lenient as to mean nothing for the average criminal. For all the good prison does these days in getting criminals back ‘on the right path’ we might as well sentence them to a year in Butlin’s. Statistics have consistently shown that most of those sentenced to less than eighteen months automatically return to crime, sometimes within days of release.

On the other hand, those who get Community Service have no incentive to ‘go straight’. It is a fact that most times they do not turn up for work, and when they do they skive off somewhere. There is almost no supervision, and those sentenced to it find it a joke. There is absolutely no incentive whatsoever for an habitual thief or thug to turn away from crime, mainly because it pays well, and even if caught there is practically no comeback. Judges are consistently giving lighter and lighter sentences to hardened criminals to relieve the ‘over-crowding’ in our prisons and keep the Human Right’s Nutters happy.  Their argument is that even a serial child molester/rapist or serial killer has the right to his own cell  along with all the comforts of home.

Personally, I see nothing wrong with there being two, three, or even four prisoners to a cell and if they don’t like it, don’t do the crime! All the comforts currently enjoyed by serious criminals should be removed until they are left with a bed, a wash basin, and a toilet. For most less serious crimes, even six months of living in those conditions would be enough to deter all but the hardened criminal away from crime. The sentence received would be dependent on the criminal record and the crime. Serious offenders would live in the same conditions, but for a much longer period. Another factor is that criminals should be made to do hard labour 12 hours a day. All this pussyfooting around with pool tables, TV’s etc should be banned.

As for the joke known as Community Service, that should be banned entirely and replaced with prison time, for even three months in a prison with a harsh regime will be enough to persuade most, if not all petty criminals that crime does not pay. At the moment it does, and criminals are making large amounts of money at the expanse of the pain and misery of their victims. It has to stop, and to hell with their human rights until such time as they can prove themselves to be fit to re-join society. We can at least be happy that the Justice Minister Damian Green has rejected the proposals outright as he should.

In a speech to Magistrates in Canary Wharf London Mr. Green said “I think that would not just send the wrong signal to criminals and the public, it would send the wrong signal to victims. Repeat offending, even non-violent theft, can be a huge problem for an individual family, for an individual victim and can often blight a whole community. Habitual, prolific offenders should have the fear of prison hanging over them.” I agree with that except for one point, what is there to fear from a prison sentence these days except the loss of freedom of movement?

The Victim Support Group had this to say:  “Victims tell us they want more than anything else the punishment to fit the crime and for the criminal not to re-offend”.

Quite right I say, make criminals wish they had never crossed the line! There is too much emphasis on the criminals Human Rights and not enough on the victim! That has to change.

Britain must surely be the ‘Compensation’ capitol of the world, for in no other country can such ridiculous claims be made. It has come to light that an on-duty policewoman sued the owner of a petrol station in Thetford, Norfolk after she came to check out the premises following a 999 call to the police station. It seems the security alarms went off and the owner, Steve Jones called the police, suspecting a break in. Officer Kelly Jones went with the owner to check out the premises and tripped over a kerbstone. She made no mention of injuries at the time and continued to check out the situation until everything was found to be satisfactory.

Several months later Mr. Jones heard the policewoman was suing him for damages because she hurt her wrist and leg, and he, according to the lawyers, failed to keep her safe while she was investigating the possible break-in. “It’s implying that I virtually should have done her job for her, it’s implying I didn’t keep her safe on my premises,” Mr Jones said.

That’s strange, I always thought it was the police’s job to keep us safe????? Just goes to show that we, the public, need to read the fine print!!!!

It has recently been revealed that Ms. Jones was signed off work for six weeks by a doctor, and contacted the Police Federation who asked if she wished to make a claim. Kelly later heard from a law firm in London. It was estimated that she could receive as much as £50,000 if she won the case.

The Police Federation said that most(?) officers put the safety of the public above their own adding: “On occasion private prosecutions and civil claims are made by police officers and they must be treated each on their own merits. However, we share the public view that policing is a job that carries with it a reasonable amount of risk, at times much higher than that.

Norfolk Chief Constable Phil Gormley reportedly said, “This type of claim does not represent the approach and attitude of the overwhelming majority of our staff who understand and accept the risks inherent in policing. It is a disappointment this is potentially undermined by a private compensation claim.”

After all the hullabaloo surrounding the case, Officer Jones has finally decided to drop it. Her father told the press, “Kelly’s very proud of being a policewoman and she loves her job. She’s got a perfect record and just likes helping people. She makes me very proud but I can’t help worrying about her”. Taking all this into account, it would seem she, like many others before her, has been very badly advised, but that is not unusual in such situations when compensation lawyers think there is money to be made.

But personally, I believe this case once again highlights the crass stupidity of the current liability laws and the entire ‘compensation culture’ that has grown out of all proportion in Britain today. Firstly, policewoman Kelly should simply watch where she’s putting her feet. If she trips over a kerb it’s her own fault, or perhaps her lawyers think she should sue the council for putting it there in the first place!!!!

Compensation leeches should be kept in a padded room where they have no chance of hurting themselves, but on reflection I guess that won’t work either. They would have to be fed, and if they developed the hiccups after a meal, would most likely be told to sue the cook!!!

The world is mad and getting madder by the minute so I guess its about time the government stepped in and put down some ground rules for situations like this. The whole compensation farce has grown like a cancer in the country, and it will only stop when the devious, dishonest ‘compensation lawyers’ and ‘ambulance followers’ are put out of business for good. Naturally, there are cases where such action is justified, if for example it’s due to someone’s negligence like insufficient safety guards at work. The only way to avoid an accident is not to be stupid, and watch what you are doing!

Update 7/4/13:

It would seem that Ms. Jones has had second thoughts about her ongoing claim for compensation from the garage owner Steve Jones and she now intends to go ahead with the claim. Not only that, but she is also suing the her own employers, i.e. the police, for damages for a knee injury she sustained after the garage incident during a high-speed chase in a police car. She is apparently taking these actions on advice from the Police Federation which is the police union. Despite severe criticism from her bosses. It would seem her desire for a career in the police is not as important as screwing money out of people.

I guess none of us should be amazed at the results published in a report by the Association of British Insurers (ABI) which states that Britain is now the ‘whiplash capitol of Europe’. It’s so easy to get some free cash from some insurance company with a whiplash claim if you get ‘rear-ended’ in your car, but in Britain today it has reached epidemic proportions.

From the report, it seems that one in every 140 people in the UK claim this injury each year. In fact, 1,200 claims are made every day against insurers, which makes up three quarters of all personal accident claims in the country in a single year. This puts Britain at the top of the league by a mile!

James Walton, the ABI’s assistant director of motor and liability, said: “Despite the statistics I doubt that the UK has some of the weakest necks in Europe. He added: “It is often difficult to diagnose, easy to fake and exaggerate….whiplash is a fraudster’s dream.”

Part of the problem is the ‘Compensation Culture’ that exists in Britain today. There are professional ‘ambulance chasers’ who will pop up at an accident scene telling you they will assist you in getting compensation. It would not surprise me if they, in some cases, even suggest to the victim he has whiplash!

The problem has become so rife that some tricksters deliberately cause themselves to be rear-ended by unsuspecting motorists just to make a claim for whiplash, knowing full well it cannot be disproved medically.

We have sunk so low these days that for some this is a way of life, and they laugh all the way to the bank.

Oh Sh*t! I Know The Feeling!

These ‘injuries’ cost the NHS about £8 million a year and the insurance companies around £2 billion, so its not surprising the price of car insurance went up by 40% last year. On top of the false injury claims, the number of people driving without any insurance at all is going through the roof. Obviously, as premiums get higher so do the number of people driving without cover.

When you come down to it, these false claim parasites have a lot to answer for. To them I say, the next time you feel like ‘stiffing’ some insurance company for a few thousand you might remember the harm you are doing to everyone else: But on balance, I think there is more chance of finding a snowball in Hell!

Time to Start Shooting Compensation Tribunals!

Remember the old adage “Cheats Never Prosper”, well, that was before someone invented Compensation Tribunals! A couple of days ago I gave my thoughts on the case of Tilern DeBique (Sorry! Can’t go to War Today I Must Feed My Baby 13/4/2010) But today more amazing revelations came to light. Miss DeBique is claiming compensation from the army to the tune of £1,140,000 for sex discrimination over army childcare. This amount is for loss of earnings, loss of army benefits, loss of pension rights, aggravated damages, and £18,000 for ‘hurt feelings’!

The amount she could receive has been described as ‘indecent’ and ‘perverse’ by officials, but I say ‘plain lunacy’ would be more like it. The Board will inform her tomorrow of the exact amount she will receive. I hope it is one penny, and even that would be too much.

All this despite the army offering her a posting with childcare, which she declined because ‘she only had four days to decide’, and because she applied for a lucrative civilian job in Afghanistan.

The most shocking thing about the whole affair is that a Para who received 37 different injuries, including losing both legs and brain damage from a land-mine, was awarded a ridiculous £152,150 compensation! After a huge outcry from the public this was increased to £570,000 with much grinding of teeth at the M.O.D.

In a similar comparison, an M.O.D office worker who strained his back lifting a printer received £207,000, but Sergeant Stephens received only £209,000 initially for multiple severe shrapnel injuries he got during a mortar attack by militants in Iraq. This was eventually increased to £317,715 when new rules came into force. An RAF typist laughed all the way to the bank with her £484,000 pay-out because she injured her thumb typing. She ‘developed’ repetitive strain injury and could not work anymore! That much for a thumb? The mind boggles!

It just goes to show how rotten and disgusting this whole ‘compensation’ scheme has become. For some people it is now a way of life, and the sad part about it is, they get away with it because these ‘Bleeding Heart’ Compensation Boards can’t wait to give other people’s money away to these ‘poor unfortunates’.

Ill-Gotten Gains

Miss DeBique and her family must think Christmas has come early, for with her credentials she wouldn’t make the amount of money she is claiming in her entire life! And on the other side of the fence are our soldiers returning from a war zone, many with horrific injuries, and they are getting peanuts by comparison.

While I don’t begrudge the injured soldiers their pay-outs, I have to wonder what all our soldiers who fought in two world wars would have to say about the compensation scheme employed and misused by so many today. They went to war to defend our nation and never had the opportunity of compensation. When they came home after the war they got nothing, not even sympathy, and many couldn’t even get a job such was the thanks of a ‘grateful nation’.

We have without doubt become a sorry excuse for humanity.

Update:

Well, one may assume there is maybe one small shred of justice still left in the UK after Miss DeBique was awarded just £17,016 today by the Tribunal. If she dreamed of living in a mansion and driving a Ferrari on her home island of St. Vincent, then thankfully she can forget it!

She was criticised by the Board for not taking the alternate posting with child-care offered her by the army, and for not trying hard enough to find work after she left. I guess she will have to find some other way of scamming the rest of us into giving her the lifestyle she wants.

Maybe now the M.O.D will take a closer look at the advisability of having unmarried mothers in the army. Lets hope so, for if not this may be the pattern of things to come.

As for my title of shooting Compensation Board members, perhaps it will be sufficient if we just wound them……slightly!
